This morning I had a consultation with a client.

So, what’s new and exciting about that? You are asking yourself, no doubt.

Nothing, for me.

Except that her case was over in 2006! But, if my clients have questions, I am here for them.

Even years later.

Sometimes issues come up long after we are finished with the case. I am always here, you don’t get a bill for the call. I am happy to answer questions.

The question you MUST ask any lawyer about bankruptcy

Yesterday I spoke with a couple who came to see me after consulting with another attorney. The other attorney was an experienced bankruptcy attorney, but I knew that his experience was limited to chapter 7. Not surprisingly, the couple informed me that this attorney recommended that they file a Chapter 7. Unfortunately, the attorney told them that they would have to lose their vehicle, their boat, and their camper as well. Because they didn’t like this scenario, they started looking around for another attorney to speak with so that they could obtain a second opinion. It’s a very good thing that they did

When you go to an attorney, you should find out if the attorney has all the tools in his toolbox to take on your situation. So, what questions should you ask? Simply this: How many Chapter 7 cases and Chapter 13 cases have you filed in the last 12 months?

This simple question will reveal to you instantly whether or not this attorney has the kind of experience in both of the chapters that consumers typically file so that you can be relatively certain that you will receive good advice.

Drowning in Debt & Don’t Know What to Do?

If I could chose one or two phrases that I hear most often, I would have to say that these are the two winners.

“Rick, I hate the thought of filing bankruptcy, but I am just drowning in debt.  I don’t know what to do.”

I hear it every day.

Sure, it’s no fun, but finding out what your options are, especially if you are facing a lawsuit or garnishment, is important. Most people have more options than they know.  In fact, most folks are pleasantly surprised to learn that they can discharge all of the debt that they cannot afford to pay, which leaves the money needed for living expenses and paying for what they need to keep.

This is a really startling realization for most.  Because they have been told all their lives that bankruptcy was bad.  It signifies failure, and means that they must have done something wrong.  Nothing could be further from the truth.
