Yesterday I spoke with a couple who came to see me after consulting with another attorney. The other attorney was an experienced bankruptcy attorney, but I knew that his experience was limited to chapter 7. Not surprisingly, the couple informed me that this attorney recommended that they file a Chapter 7. Unfortunately, the attorney told them that they would have to lose their vehicle, their boat, and their camper as well.     Would filing chapter 13 save their boat, car and camper?

    Indeed! It did save their boat, camper, car and the first attorney told them that they just had to “suck it up” and lose it as the “price they had to pay” to get rid of their debt and file a chapter 7.

    WRONG!

    The price they had to pay to KEEP it all was $85 per month in a chapter 13.

    We are seeing an increasing number of cases filed as Chapter 7 which result in unnecessary loss of property by consumers.
