Guarantee 8 – Discharged Debts Stay Discharged
Your discharge debts stay discharged. We guarantee that your bankruptcy discharge will forever and always get rid of all of your dis-chargeable unsecured debt, usually your credit card debts and medical bills.
It will also get rid of other debts that you don’t decide to keep in your bankruptcy.
We have heard that some creditors threaten that they can come after you and collect the debt after your bankruptcy has been filed.
Not True.
More lies and empty threats. Creditors can never come back after the case is over and you’re granted your discharge and try to collect from you later.
Once a discharge you are guaranteed not to have to pay that debt. Ever. Period.
Now there are some common sense kind of exclusions from this because not all debts can be legally discharged.
We’re talking mainly about medical bills and credit card debt.
You can’t discharge alimony or child support or domestic support obligations or debts that you incurred to pay taxes that would not be dis-chargeable.
Student loan debts are hardly ever discharged, there are some others listed on the website but basically the guarantee is this Your bankruptcy discharge is permanent.
And what you discharge – meaning your unsecured debts – are guaranteed
To be discharged for life, neither you nor your family or your beneficiaries after your death can ever be made to pay debts that you discharge in your bankruptcy.
Common sense limitations on this guarantee: This only applies to credit card and medical debt you owe when we file your case, and doesn’t include debts you did not tell us about, or alimony, child support or a domestic support obligation, or debt you incurred to pay taxes. We also assume no fraud or similar actions that would prevent debts from being discharged. We base this guarantee on the law as interpreted March 1, 2010, and our guarantee does not cover debt you pay because of being co-signed or guaranteed by another. When in a Chapter 13, you have to have done all the things listed in our discharge guarantee, like making your plan payments on time, etc, and finishing your case completely to the point of discharge.
