The bankruptcy process can be divided into three stages. The first stage is the pre filing stage which begins with a consultation with a bankruptcy attorney.

After that, you are required to obtain a number of documents and prepare information for the attorney to create a bankruptcy petition. This can take anywhere from several days to several months. Once the attorney has the information necessary to prepare the petition, it generally doesn’t take too long for the attorney to prepare the petition for the consumer to review and sign.

Once the petition is filed with court it generally takes four to eight weeks for that consumer to meet with the bankruptcy trustee. After that it takes about three months for the chapter 7 discharge to issue and it takes three to five years to complete a Chapter 13 plan.
