Bankruptcy stops all forms of collection including wage garnishments. However, it is important to understand that it is the filing of the bankruptcy case which invokes what in bankruptcy law is referred to as the automatic stay – and this is what stops the wage garnishments or other collection activity. Simply visiting an attorney to discuss bankruptcy or even hiring an attorney to file your bankruptcy case will not stop the wage garnishments.
